HSB Maintenance Fund

The Maintenance Fund is a crucial component of the community’s financial structure. Here’s a breakdown of its key aspects:
  • Creation and Purpose: Established by the Declaration of Reservations of Horseshoe Bay, the Maintenance Fund is responsible for collecting and distributing the maintenance fees required by the Declaration.
  • Separation from POA: The Maintenance Fund operates independently from the Horseshoe Bay Property Owners' Association (POA).
  • Fees Structure:
    • Annual Fee: Each lot, tract, or dwelling unit in the subdivision (excluding those owned by the Declarant or the Amenities Owner) is subject to an annual maintenance fee.
    • Payment: The fee is payable in advance each January 1st.
    • Uniform Fee: The fee is the same for all lots and tracts, regardless of whether they have dwelling units.
Adjustment Mechanism: The Maintenance Fee may be adjusted based on a calculation described in the Declarations, which uses the Consumer Price Index to determine increases or decreases.
This system ensures that maintenance costs are fairly distributed and adjusted according to economic conditions.
